Terms of Use of the Affiliate Program

Welcome to the EscortVibe Affiliate Program (the "Program"). These Terms of Use of the Affiliate Program ("Affiliate Terms") govern your application to, participation in, and use of the Program offered by EscortVibe (the "Site", "we", "us", or "our").

By applying to become an affiliate ("Affiliate", "you", "your"), you agree to be bound by these Affiliate Terms. If you do not agree, please do not join or participate in the Program.

1. Definitions

"Program" means the EscortVibe affiliate marketing program.
"Affiliate" means an individual or entity approved to promote EscortVibe in exchange for commissions.
"Commission" means the percentage or fixed amount paid to Affiliate for a Qualified Action.
"Qualified Action" means a new paying advertiser (escort, agency, or companion service) who signs up via the Affiliate's unique tracking link and makes a first payment.
"Tracking Link" means the unique URL provided to each Affiliate to track referrals.

2. Affiliate Application and Approval

To participate in the Program, you must submit an application. We reserve the right to accept or reject any application at our sole discretion, without explanation. Approval is contingent on compliance with these Affiliate Terms and applicable laws.

3. Affiliate Obligations and Prohibited Activities

As an Affiliate, you agree to:

• Promote EscortVibe only through lawful, ethical, and non-deceptive methods.
• Clearly disclose your affiliate relationship with EscortVibe where required by law (e.g., FTC guidelines).
• Use only the tracking links provided; no direct linking to pages without proper tracking.

You are strictly prohibited from:

• Using spam, unsolicited email, or automated messages to promote EscortVibe.
• Bidding on branded keywords (e.g., "EscortVibe", "EscortVibe affiliate") in pay-per-click campaigns without prior written consent.
• Creating fake accounts or incentivizing sign-ups that are not genuine advertisers.
• Engaging in any activity that violates the laws of your jurisdiction or the United States.
• Promoting EscortVibe on websites that contain illegal, obscene, hateful, or infringing content.

4. Commissions and Payouts

Commissions are earned only for Qualified Actions as defined in Section 1. The current commission rate is [e.g., 20% of the first payment] (or as communicated separately). We reserve the right to change commission rates at any time with reasonable notice.

Payments are made monthly, provided the Affiliate has earned a minimum payout amount (e.g., $50 USD). Payments are sent via [PayPal / Bank Transfer / other method as determined by EscortVibe].

No commission is paid for:

• Referrals that are already existing EscortVibe advertisers.
• Refunds, chargebacks, or fraudulent transactions.
• Self-referrals (signing up using your own tracking link).

5. Tracking and Attribution

Qualified Actions are tracked using cookies placed via the Affiliate's unique tracking link. The cookie duration is [e.g., 30 days]. If a potential advertiser clicks multiple affiliate links, the last click before sign-up generally receives credit. We are not responsible for tracking failures due to browser settings, ad blockers, or technical issues beyond our control.

6. Affiliate Program Platform Only

The Affiliate Program is a referral marketing arrangement only. We do not provide any guarantees of earnings, and we are not responsible for the success or failure of your promotional efforts. You are an independent contractor, not an employee, partner, or agent of EscortVibe.

7. Termination

Either party may terminate the affiliate relationship at any time, for any reason, by providing written notice. We may terminate your participation immediately without notice if you violate these Affiliate Terms or our main Terms of Use. Upon termination, any unpaid commissions that were earned prior to termination will be paid within [e.g., 60 days], except if termination was due to fraud or violation – in which case all commissions are forfeited.

8. Limitation of Liability and Disclaimer

EscortVibe is provided "as is". We make no warranties regarding the Program's availability, performance, or potential earnings. To the fullest extent permitted by law, we are not liable for any indirect, incidental, or consequential damages arising from your participation in the Program. Our total liability shall not exceed the total commissions paid to you in the six months prior to the claim.

9. Indemnification

You agree to indemnify and hold harmless EscortVibe from any claims, damages, or expenses arising from your promotional activities, violation of these Affiliate Terms, or violation of any law.

10. Governing Law

These Affiliate Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States of America, without regard to its conflict of law principles.

11. Changes to These Terms

We may update these Affiliate Terms at any time. Material changes will be communicated via email or a notice on our website. Your continued participation in the Program after changes constitutes acceptance.
